Terms of Use of the «Yandex ID API» Service

These Terms of Use of the «Yandex ID API» Service (hereinafter referred to as the «Terms») constitute an offer from Yandex (as defined in the Terms of Use of the Yandex ID Service) to a user – the owner of a computer program or website on the Internet – to use the «Yandex ID API» Service (hereinafter referred to as the «Service») under the terms set forth below:

1. General Terms

1.1. Terms and Definitions

Service – a software interface that offers the User the ability to provide (i) authorization of End Users in the User's Program via Yandex ID; (ii) access to the APIs of other Yandex services.

Yandex ID – a Yandex service combining authorization and registration systems for users of Yandex service accounts.

Organizations in ID – a Yandex ID feature that allows an Internet user representing a legal entity or individual entrepreneur to use Yandex services in accordance with the terms available at: https://yandex.ru/legal/org_id_termsofuse and https://yandex.kz/legal/org_id_termsofuse/.

User – the rightsholder of the Program who uses the Service through their personal Yandex ID account or through the «Organizations in ID» feature.

User's Program, or Program – a website on the Internet and/or a computer program, including mobile applications, the rightsholder of which is the User.

API Key – a unique identifier issued to the User that allows access to the Service's functions.

End Users – users registered in Yandex ID who use the User's Program and authorize in it via Yandex ID.

Data — information transmitted from Yandex ID that allows End Users to authorize via Yandex ID.

Verification — a procedure for confirming a Yandex ID account in accordance with the Terms of Use of the Yandex ID Service.

1.2. The User's use of the Service is governed by these Terms, as well as the following documents:

  • Yandex Services User Agreement,

  • Privacy Policy,

  • Terms of Use of the Yandex ID Service.

(hereinafter collectively referred to as the «Governing Documents»).

The User undertakes to familiarize themselves with all Governing Documents. In case of failure to do so, the User accepts all possible risks of not being familiar with them.

1.3. By starting to use the Service in accordance with clause 2.1 of the Terms or by using any other functionality provided by the Service, the User accepts these Terms, as well as the terms of the Governing Documents in full, without any reservations or exceptions, and undertakes to comply with them. Use of the Service under terms other than those specified in the aforementioned documents is possible only with the prior written consent of the Company. In case the User disagrees with any of the terms of the specified documents, the User is not entitled to use the Service.

1.4. The law applicable to the relations arising between Yandex and the User under these Terms is the law of the state of registration of the legal entity specified in clause 1.1 of the Terms of Use of the Yandex ID Service, with which the User entered into an agreement as a result of accepting these Terms.

All disputes and disagreements arising from the Terms or from the use of the Service shall be resolved in a court at the location of Yandex, subject to mandatory pre-trial settlement of disputes and disagreements.

1.5. The User is solely responsible for compliance with the law when using the Service. Throughout these Terms, unless otherwise expressly stated, the term «law» means both the applicable law and the law of the User's place of residence or the place where they perform legally significant actions in accordance with these Terms. If the User's use of any functionality provided by the Service violates the law of the User's place of residence, the User undertakes to refrain from using the Service.

1.6. Yandex has the right to send informational messages to the User.

1.7. These Terms may be changed by Yandex without any special notice; the new version of the Terms takes effect from the moment it is posted on the Internet at the address specified in this paragraph, unless otherwise provided by the new version of the Terms.

2. Terms of Use of the Service

2.1. To gain access to the Service, the User must create an application in the developer console at: https://oauth.yandex.ru, https://oauth.yandex.by/, https://oauth.yandex.kz/, https://oauth.yandex.uz/, https://oauth.yandex.com/ and obtain an API Key.

2.2. Yandex has the right to deny access to the Service without providing reasons. The User is not entitled to use any programs, devices, or other means that allow obtaining an API Key automatically or in any other way that violates the procedure established by Yandex.

2.3. When creating an Application, the User must choose which of the two types of Applications they intend to create: (a) an application for authorizing End Users in the Program using Yandex ID, or (b) an application for accessing the APIs of other Yandex services.

2.4. With regard to applications for authorizing Users in the Program using Yandex ID, the Service provides the User with the ability to embed a software interface in the User's Program that allows End Users to authorize via Yandex ID.

2.4.1. The User independently determines the composition of End Users' Data that is transmitted to the User, and undertakes to inform End Users about their authorization via Yandex ID.

When selecting the relevant categories of Data, the User must proceed from the minimally necessary composition of Data obtained from the Service. Yandex has the right to request at any time a justification for the User's choice of a particular category of Data and explanations regarding the purposes and conditions of processing such Data.

Yandex has the right to refuse to provide Data or a specific category of Data at any time, in the event of violations by the User of the requirements of these Terms and/or the Governing Documents, receipt of complaints/appeals/claims from End Users and third parties, detection of signs of suspicious activity in the Service, and for other reasons.

2.4.2. The User (as well as their partners and/or affiliates) may send advertising messages related to the Program to End Users using their contact data (the primary phone number and email address specified in the Yandex ID account) exclusively provided that the User obtains proper consent from the End Users. The Service's functionality provides for the User to obtain consent from End Users to send them advertising messages in the following form: «I consent to receiving advertising messages from this service.».

The burden of proving that the User has obtained proper consent from the End User to process personal data and send advertising messages using the Service lies with the User.

The User undertakes to provide End Users with the ability to withdraw consent to receive advertising messages at any time.

The User bears independent responsibility for resolving any disputes and claims arising in connection with compliance with advertising and personal data legislation, without involving Yandex.

In the event that Yandex receives claims from third parties and state and other authorities, the User undertakes to promptly, upon Yandex's request, provide Yandex with all information requested from Yandex by state authorities or third parties, assist Yandex in resolving claims, orders, and lawsuits, and compensate Yandex for any losses and damages (including legal costs) caused to Yandex in connection with the User's violation of the provisions of this clause 2.4.2 of the Terms.

2.4.3. The User undertakes to independently take measures to comply with personal data legislation regarding the Data of End Users obtained using the Service.

The User, in particular, undertakes to:

  • inform End Users about the conditions of Data processing;

  • use Data exclusively for the purpose of ensuring the functionality of the Program (or authorization in it);

  • not use the obtained Data for advertising purposes, other marketing activities, mass mailings, or cold calling;

  • ensure an adequate level of protection of the obtained Data;

  • not transfer Data to third parties if such transfer has no basis related to the fulfillment of contractual obligations to the End User, consent obtained from the End User, or other grounds provided by applicable law.

Yandex has the right to send a request at any time containing a request to confirm compliance with the above requirements, or to demand explanations regarding information about non-compliance with these requirements.

In case of ignoring the request, or confirmation of information about the User's non-compliance with obligations established by law or these Terms regarding Data processing, Yandex has the right to restrict the User's access to the Service.

2.4.4. The User guarantees that their use of the Service does not impose any obligations or restrictions on Yandex in accordance with applicable law.

2.4.5. The User is prohibited from using the Service to authorize End Users via Yandex ID if the Program does not comply with the legislation of the Russian Federation, violates the rights and legitimate interests of Yandex or third parties, the terms of Yandex services, or is capable, in Yandex's opinion, of harming Yandex's reputation. 2.4.6. The functionality of the Service for authorizing End Users using Yandex ID varies depending on whether the User has undergone the Verification procedure.

2.4.7. A User who has not undergone Verification is provided with limited Service functionality, namely:

  • Limited configuration of End User authorization via Yandex ID into their Programs (up to 20 Programs).

  • For End Users authorizing in the User's Program, a warning will be displayed that the User has not undergone Verification.

  • A limited list of purposes for using data obtained from the End User.

2.4.8. A User who has undergone Verification has access to extended Service usage capabilities:

  • Extended configuration of End User authorization via Yandex ID into their Programs (up to 50 Programs).

2.5. With regard to applications for accessing the APIs of other Yandex services, the Service provides the ability to access the APIs of other Yandex services.

2.5.1. The use of APIs of other Yandex services is carried out in accordance with the terms of use of the relevant API.

2.5.2. Gaining access to the APIs of other Yandex services in accordance with these Terms does not in all cases mean immediate access to the functionality governed by the terms of use of the API of the relevant Yandex service. Some Yandex services may establish additional requirements for gaining access to the functionality of their APIs.

2.6. The User may independently terminate the current API Key in the partner console interface or by contacting the Service's support team.

2.7. Yandex reserves the right to set any restrictions related to the use of the Service, as well as to change restrictions at its own discretion, without prior written notice to Users.

2.8. Yandex reserves the right to modify, fix, or update the Service at any time, without prior notice to Users. After releasing a new version, Yandex does not guarantee the stability and duration of operation of the outdated version. A User who does not agree to use the updated version of the Service may either continue to use the outdated version of the Service at their own risk, or cease using the Service.

2.9. Yandex has the right, at its own discretion, to terminate or suspend the User's access to the Service without notice and without providing reasons, in particular, in the event of the User's violation of the requirements of these Terms.

3. Intellectual Property Rights

3.1. The exclusive right to the Service belongs to Yandex.

3.2. When using the Service, the User is not entitled to remove, hide, or modify any trademarks, logos, links, or other references to Yandex or other persons contained in the Service or in data obtained with its help, as well as any other notices and/or information transmitted by the Service.

3.3. By using the Service, the User grants Yandex the right to use the User's logo, trademark and/or trade name and/or the User's website for informational, advertising, and marketing purposes without the need to obtain additional consent from the User and without paying any remuneration for such use.

3.4. The User is not entitled to modify, decompile, and/or in any way modify the source code obtained through the Service. The User is not entitled to use the Service to create internet services, computer programs, or in any other way if such use results in a violation of law, Governing Documents, and/or the rights and legitimate interests of third parties.

4. Disclaimer of Liability

4.1. The Service is provided by Yandex «as is». Yandex does not guarantee that the Service meets the purposes and expectations of Users, uninterrupted and error-free operation of the Service as a whole and of its individual components and/or functions.

4.2. Yandex is not liable and does not compensate for any damage, direct or indirect, caused to the User of the Service or third parties as a result of the use or inability to use the Service.

4.3. The User is solely responsible to third parties for their actions when using the Service, including for ensuring that they comply with legal requirements and do not violate the rights and legitimate interests of third parties. The User independently and at their own expense undertakes to resolve all claims of third parties related to the User's actions when using the Service, in particular for violations of personal data legislation and advertising legislation.

4.4. The User is solely and fully responsible for the use and safekeeping of their API Key. The User is not entitled to obtain an API Key for third parties, transfer it, or provide it to third parties. Yandex is not responsible for unauthorized use of the API Key by third parties. All actions performed on the Service using the API Key belonging to the User are considered to have been performed by the User.

4.5. Yandex does not verify the reliability, relevance, accuracy, and correctness of Yandex ID Data and is not responsible for their content.

The User may rely on the obtained Data at their own risk, as well as independently require confirmation from the End User.
