Yandex.Maps API Terms of Use

This document is a translation of API Yandex.Maps Service User Agreement in English. In case of conflict between the Russian version of API Yandex.Maps Service User Agreement and this translation - only the Russian version of API Yandex.Maps Service User Agreement is legally binding. This API.Yandex.Maps Service User Agreement (hereinafter referred to as the “Agreement”) constitutes an offer of YANDEX LLC (hereinafter referred to as “Yandex”) to Internet users (hereinafter referred to as the “User”) to use the API.Yandex.Maps Service (hereinafter referred to as the “Service”) on the terms and conditions set out below:

1. General Terms

1.1. The use of the Service by the User shall be regulated by this Agreement, as well as by:

(hereinafter collectively referred to as - Regulatory Documents).

The User undertakes to read all of the said Regulatory Documents and shall personally bear the risk of failure to familiarize him/herself therewith.

1.2. This Agreement as well as relations between Yandex and the User arising in connection with the use of the Service shall be governed by the law of the Russian Federation.

1.3. The User shall bear personal responsibility for compliance with the law in using the Service. In all parts of this Agreement, unless expressly stated otherwise, the term “Law” shall mean both the law of the Russian Federation and the laws of countries of the User’s current location, as well as of other jurisdictions where he performs legally significant acts hereunder. If the User runs any function or feature provided by the Service, which is found in breach of the laws of the User’s current location, the User shall refrain from using the Service.

1.4. By using the Service, posting the Service code on the User’s Web site or User`s mobile application (subject to transfer of HTTP Referer heading in the manner of http://app_id_in_store.ymapapp which allows to precisely identify the application), or using any other function of the Service, the User expresses his full and unconditional acceptance of all the requirements set out in the Regulatory Documents and undertakes to comply therewith. Using the Service on conditions other than those provided herein shall not be allowed unless authorized in writing by Yandex. In case of non-acceptance of the terms and conditions laid out in the Regulatory Documents the User may not use the Service.

2. Terms and Conditions of Service

2.1. The Service represents a programming interface enabling interaction with the Yandex.Maps and Yandex.People’s Map services, including with Data of the said services, and using their functionality on the User’s Web site(s) or User`s mobile application(s).

2.2. Terms and Definitions

“Data” means the Service-provided information to show the User, including but not limited to, maps, satellite photo images, other photos, and user data.

“Rights Owners” are persons/entities having legal ownership rights to the Data.

"Geocoder" provides a Service function of converting location addresses into map or satellite image references.

2.3. The Service may be used on the basis of compliance with the following requirements:

2.3.1. To obtain access to the Service, the User must post a Service request code on the Web site or mobile application. Yandex may at its discretion deny the requested access without giving any reason.

2.3.2. The Service may be used by the User only within the framework of the Web sites or mobile aplication accessible for free unlimited access. The Service may not be used in fee-based or otherwise restricted third-party access projects. The registration requirement hereunder shall not be deemed to constitute a limitation to access.

2.3.3. The User may use the Data and functions obtained by means of the Service only within the limits of the functionality as provided by the Service.

2.3.4. Yandex reserves the right to impose any limits and restrictions given below, including but not limited to: the size, scope, colour scheme and the number of map images, plan or satellite images provided by the Service, and to change them at its own discretion without prior written notice to the Users.

2.3.5. The User grants Yandex the right of use the information and objects (location maps, objects on a map, etc.) which the User posted on the Data using API of the map constructor, by any means in full scope. Posted by the User using the Service the information and objects can be used on other services and resources of Yandex, as well as with the consent of Yandex on the resources of the third parties. In case the User is not entitled to grant to Yandex right of use any information or objects in this way, he is not entitled to submit them using the Service. Yandex is the right holder of the database, which is a set of information and objects, created with the use of the Service.

2.3.6. Geocoding. The geocoding function may only be used for Web sites or mobile applications using the Service. The User may process the obtained image geo-references for mapping them exclusively by means of the Service. The number of geocoding queries is limited to 25,000 per Web site or mobile application a day.

2.3.7. RESTRICTIONS. While using the Service, the User shall not:

2.3.7.1. Change, decompile and/or otherwise modify the program code obtained by means of the Service.

2.3.7.2. To remove, change the array or sorting order of, hide or modify, any Data as well as any information contained in the Service or the Data, including, but not limited to, promotional and informational materials, trademarks, logos, links or other references to the Right Holders, as well as any other notifications and/or information transmitted by the Service with the Data.

2.3.7.3. Use the Service as the basis for developing real time traffic monitoring systems with online data imaging capabilities, and any other services for traffic management and control.

2.3.7.4. Create gaming projects on the base of the Service

2.3.7.5. Save, process and modify the Data obtained by means of the Service (including geocoding data), except for temporary storage (caching) of geocoding data for the sole purpose of improving the functionality and performance capacity of the Service and for using exclusively within the limits of functions as provided by the Service.

2.3.7.6. Use the Service for creating Web sites or mobile applications in violation of the Law, rights and legitimate interests of third parties, or non-compliant with the requirements of Clause 4 of the Yandex User Agreement.

2.3.8. Modifications and Versions. Yandex hereby reserves the right to modify/fix or update the Service at any time without prior notice to the Users. Yandex undertakes to announce releases of new stable versions on web pages of the Service. Yandex shall not guarantee the stability and duration of performance of a legacy version. The User who does not wish to use an updated Service, may either continue to run the legacy version at his/her own risk, or terminate using the Service by removing the appropriate code from the User’s Web site(s) or mobile application.

2.3.9. Advertisements. Yandex reserves the right at its sole discretion to incorporate ads into Data provided and displayed by the Service.

3. Rights and Rights Owners

3.1. Yandex is the exclusive owner of the rights to the Service. The exclusive ownership rights to Data (including map data, photographic imagery, ads, any trademarks, logos and trade names) belong to Yandex or the appropriate Rights Owners. This Agreement does not entitle the User to using the Service or Data beyond the scope of the functions provided directly within the Service interface as defined herein.

3.2. By using the Service the User shall authorize Yandex to use the logo, trademark and/or trade name of the User and/or the User’s Web site/mobile application for information, promotion and marketing purposes relevant to the Yandex.Maps, Yandex.People’s Map and/or API Yandex.Maps services, without the need for seeking approval from and paying any fee to the User for the above.

4. Disclaimer

4.1. The Service (including the Data and other information obtained by it) is provided by Yandex “as is”. Yandex shall not guarantee that the Service and Data will meet the User’s objectives and expectations, or will ensure uninterrupted and error-free performance of the Service as a whole or individual components and/or functions thereof; nor shall it guarantee the accuracy, completeness and timeliness of the Data provided by the Service. Yandex shall not be deemed liable and shall not reimburse any losses, including damages, direct or indirect, incurred by the Service User or third parties as a result of using or inability to use the Service, its individual components and/or functions, as well as damages consequential to using or inability to use Data provided by the Service.

4.2. The User hereby understands and agrees that the plan contained in the Data, which is based on the user data of the service Yandex.People’s Map, does not constitute a map image as defined by the Federal Law of 12/26/1995 # 209-FZ “On Geodesy and Map Making”. Yandex shall not guarantee the geometric accuracy and line-up of the Data on the map projections.

4.3. The User must personally evaluate the authenticity, reliability, completeness or usability of the Data, and he shall personally bear all the risks related to using (inability to use) the Service and Data, as well as shall assume the liability to third parties for his actions performed in using the Service and Data, including for ensuring compliance with the Law and respect for the rights and legitimate interests of third parties. The User shall undertake personally and at his/her own cost to settle all claims and/or legal actions of third parties initiated in connection with Service-related actions performed by the User.

4.4. The User understands and agrees that use, reference to or posting on the Service of any data about organizations, businesses, private individuals, products, services, including identification notes and/or references contained in the Service and Data, shall be exclusively informational and shall not be regarded as suggesting that they enjoy any special support, endorsement or recommendation by Yandex.

5. Final Provisions

5.1. Yandex may at is own discretion terminate or suspend the User’s access to the Service without giving any reason, e.g. for the User’s non-compliance herewith.

5.2. All questions and claims relating to using or inability to use the Service must be submitted via our feedback form available at http://feedback.yandex.ru/?from=api-maps.

5.3. Yandex may change the text of this Agreement, Regulatory Documents and/or any other requirements for using the Service at any time and without prior notice to the User. The current version of this Agreement is posted at: https://yandex.kz/legal/maps_api. The risk of failure to read the revised version of the Agreement or Regulatory Documents shall be borne by the User and continued use of the Service after the revision of the Agreement and/or Regulatory Documents shall be deemed to constitute acceptance thereof.

6. Right holders
