Terms of Use of Yandex.Maps API

This document is a translation of Yandex.Maps API Terms of Use in English. In case of conflict between the Russian version of Yandex.Maps API Terms of Use and this translation - only the Russian version of Yandex.Maps API Terms of Use is legally binding. These Terms of Use of Yandex.Maps API (hereinafter referred to as the Agreement) represent an offer of YANDEX LLC (hereinafter referred to as Yandex) to an Internet user (hereinafter referred to as the User) to use Yandex.Maps API Service (hereinafter referred to as the “Service”) under the terms and conditions stipulated below:

1. General Provisions

1.1. The use of the Service by the User shall be governed by this Agreement and

(hereinafter jointly referred to as the “Regulatory Documents”).

The User undertakes to review all Regulatory Documents, and he/she shall bear the risk of failure to review these documents at its own discretion.

1.2. This Agreement and relations between Yandex and the User arising in connection with the use of the Service shall be governed by the laws of the Russian Federation.

1.3. The User shall be independently liable for compliance by it with Laws when using the Service. Throughout the text of this Agreement, unless otherwise expressly specified, the term “Laws” shall mean both laws of the Russian Federation and laws of the User’s residence or a place where he/she commits legally significant actions in accordance with this Agreement. If the use by the User of any options provided by the Service violates the laws of the User’s residence, the User undertakes to refrain from using the Service.

1.4. By using the Service, having posted the code of the Service on the User’s website or in the User’s application (in case of the application – given the Referer HTTP header is specified as http://application_ID_in_the_store.ymapapp making it possible to unambiguously identify the mobile application), or having used any other functionality provided by the Service, the User expresses his/her full and unreserved consent to all terms and conditions of the Regulatory Documents and undertakes to comply with them. The use of the Service subject to any terms and conditions other than specified herein is only possible subject to a written agreement with Yandex. If the User disagrees with terms and conditions of the Regulatory Documents, he/she may not use the Service.

2. Terms of Use of the Service

2.1. The Service represents a programming interface enabling interaction with Yandex.Maps and Yandex.People’s Map Services including the Data of these services and possible use of functionality provided by these services on website(s) or applications of the User including with the help of Static API.

2.2. Terms and Definitions

The “Data” shall mean information received from the Service and meant to be displayed to the User including but not limited to cartographic works, satellite images, other photographic pictures and user data.

The “Copyright Holders” shall mean entities legally holding the rights to the Data.

The “Geocoder” shall mean a function of the Service transforming addresses of objects into their coordinates on the map or the satellite image and backward transforming coordinates on the map or the satellite image into addresses of objects.

The “Router” shall mean a function of the Service enabling automated routing in the Service.

The “Panoramic Pictures” shall mean a function of the Service enabling search for and display of photographic panoramic pictures of the location.

The “Static API” shall mean a function of the Service enabling receipt of the Data in the form of a static picture.

The “Map Constructor” shall mean a function of the Service enabling creation of a map with the User’s objects.

2.3. The use of the Service shall be allowed only subject to the following conditions:

2.3.1. To obtain access to the Service, the User shall post the Service access code on the website or in the application. Yandex shall be entitled to refuse access to the Service at its own discretion without giving reasons.

2.3.2. The Service may be used by the User only within websites or applications available for free open use by the public. The Service may not be used for projects requiring payment or otherwise limiting access of third parties to them. The requirement to register shall not be deemed access restriction within the meaning hereof.

2.3.3. The User may use the Data and functions received through the Service only as part of the functionality provided by the Service.

2.3.4. Yandex reserves the right to set any limits and limitations including those listed below but not limited to: sizes, volume, color appearance and number of images for map, scheme or satellite images provided through the Service, and it may change them at its own discretion without prior notice to the User.

2.3.5. The User transfers to Yandex the right to use information and objects (access schemes, objects on the map, etc.) which the User placed at its own discretion using Map Constructor API by any means in full. Information and objects placed by the User using the Service may be used in other services and resources of Yandex, and resources of third parties with the consent of Yandex. If the User may not provide Yandex with the right to use any information or objects in this way, it may not post them using the Service. Rights to the database representing a complex of information and objects created using the Service shall belong to Yandex.

2.3.6. Geocoding, Router and Panoramic Pictures:

2.3.6.1. The geocoding function may be used only for websites or applications using the Service. The User may process the obtained coordinates only to display them using the Service.

2.3.6.2. The Router may be used only for websites or applications using the Service.

2.3.6.3. The geocoder, the router and the panoramic pictures shall not be accessed more than 25,000 times per website/application a day. One access to the geocoder or the router shall mean one access; one access to the function of search for the panoramic picture being the nearest to the certain coordinate shall be made equal to five accesses, respectively.

2.3.7. LIMITATIONS. Using the Service, the User may not:

2.3.7.1. Change, decompile and/or modify the program code obtained using the Service in any way.

2.3.7.2. Delete, change order or rating, conceal or modify the Data as well as any information contained in the Service or the Data, including but not limited to promotional and information materials, trademarks, logos, links or other references to the Copyright Holders as well as any other notices and/or information transferred by the Service together with the Data.

2.3.7.3. Create systems for monitoring of vehicles displaying information on a real time basis and any other services relating to control and dispatch of vehicles on the basis of the Service.

2.3.7.4. Create game projects on the basis of the Service.

2.3.7.5. Save, process and change the Data obtained through the Service (including geocoding results), except for cases of temporary storage (caching) of the geocoding results only to improve functionality and efficiency of the Service and only for use within the Service, for a period not exceeding 30 days.

2.3.7.6. Use the Service to create websites/applications violating the laws of the Russian Federation or any other applicable laws, rights and legitimate interests of third parties, and conflicting with the requirements of clause 4 of Yandex User Agreement.

2.3.7.7. Should the User’s website or application has a daily audience exceeding 100,000 users, prior to the use of the Service, the User shall contact Yandex by sending to the address support@api-maps.yandex.ru an e-mail in which it shall specify name of the website or the application and the daily audience of users. These actions are required to ensure maximum efficiency of such websites or applications of the User.

2.3.8. Changes and versions. Yandex reserves the right to change/correct or update the Service at any time without prior notice to the Users. Upon release of the next stable version, Yandex shall inform of its release on webpages of the Service (for more details on updates, see: https://yandex.ru/blog/mapsapi?tag=novosti). Upon release of a new version, Yandex does not guarantee stable and durable operation of its outdated version. The User that does not agree with the use of the updated version of the Service may either keep using the outdated version of the Service at its own risk, or stop using the Service having removed the relevant code from the website(s)/application of the User.

2.3.9. Advertisements. Yandex reserves the right to include, at own discretion, advertisements in the Data provided and displayed by the Service.

2.3.10. Use of the Data for the purposes specified in clauses 2.3.7.3. and 2.3.7.4. shall be acceptable upon use of the fee-based Maps API posted at: https://tech.yandex.ru/maps/commercial.

3. Rights and Copyright Holders

3.1. The exclusive right to the Service is vested in Yandex. Exclusive rights to the Data (including cartographic data, pictures, promotional materials, any trademarks, logos or trade names) are vested in Yandex or the Copyright Holders. This Agreement does not grant to the User any right to using the Service or the Data except as enabled directly in the Service interface pursuant to this Agreement.

3.2. By using the Service, the User grants to Yandex the right to use the logo, the trademark and/or the trade name of the User and/or the User’s website/application for information, advertising and marketing purposes with regard to Yandex.Maps, Yandex.People’s Map and/or Yandex.Maps API Services, in particular, with no need to secure the User’s additional consent and with no remuneration paid to the User for such use.

4. Disclaimer

4.1. The Service (including the Data and other information provided with its help) shall be provided by Yandex “as is”. Yandex does not guarantee the fitness of the Service and the Data to the User’s goals and expectations, the trouble- and error-free operation of the Service in general and its certain components and/or functions, and it does not guarantee reliability, accuracy, completeness and timeliness of the Data obtained using the Service either. Yandex shall not be liable and it shall not reimburse for any losses including any damage, direct or indirect, caused to the User of the Service or third parties as a result of use or unavailability of the Service, its certain components and/or functions as well as those resulting from use or unavailability of the Data obtained through the Service.

4.2. The User understands and agrees that the scheme received as part of the Data and based on the user information of Yandex.People’s Map Service is not a cartographic work within the meaning of Federal Law No. 209-FZ On Geodesy and Cartography of December 26, 1995. Yandex does not guarantee geometric relationship and compliance with cartographic projection of the Data.

4.3. The User shall evaluate adequacy, reliability, completeness or usefulness of the Data at its own discretion, and independently bear all risks relating to use (unavailability) of the Service and the Data and liability to third parties for its actions upon use of the Service and the Data including liability for compliance of actions with the requirements of the Laws and the rights and legitimate interests of third parties. The User, at its own discretion and expense, undertakes to settle all claims and/or actions of third parties relating to actions of the User upon use of the Service.

4.4. The User understands and agrees that use, indication or publication in the Service of any information on any organizations, enterprises, entities, goods, services including indication and/or references as part of the Data and the Service shall be for reference only and shall not be deemed expression of their special support, approval or recommendation on the part of Yandex.

5. Final Provisions

5.1. Yandex may, without notice and at its own discretion, stop or suspend the User’s access to the Service, without giving reasons, inter alia, if the User fails to comply with requirements of this Agreement.

5.2. All issues and claims associated with the use or unavailability of the Service shall be sent via the feedback form at: https://tech.yandex.ru/maps/doc/geocoder/desc/feedback/troubleshooting-docpage.

5.3. Yandex may change the text of this Agreement, the Regulatory Documents and/or any other terms of use of the Service at any time without notice to the User. The current version of this Agreement is posted at: https://yandex.kz/legal/maps_api. The risk of failure to review new revision of the Agreement or the Regulatory Documents shall be borne by the User; further use of the Service after change of the terms and conditions of the Agreement and/or the Regulatory Documents shall be deemed acceptance of their new revision.
