License Agreement for Mail for Domain Program

Before using the program, please read the terms and conditions of the below license agreement.

Any use of the program means that you fully and unconditionally accept the terms and conditions of this license agreement.

If you do not accept the license agreement in full, you may not use the program for any purpose.

1. General provisions

1.1. This License Agreement (the "License") sets the terms of use of Mail for Domain (the "Program") and is signed by and between a person using the Program (the "Licensee") and YANDEX LLC, 16 Leo Tolstoy St., 119021 Moscow, Russia, being the holder of the exclusive right to the Program (the "Rightholder").

1.2. By copying the Program, installing it on his/her mobile device or using the Program in any way, the Licensee expresses his/her full and unconditional consent to all terms and conditions of the License.

1.3. It is only permitted to use the Program under the terms and conditions of this License. If the Licensee does not accept the terms and conditions of the License in full, the Licensee may not use the Program for any purpose. It is prohibited to use the Program in violation of (failing to fulfill) any of the terms and conditions of the License.

1.4. By using the Program, the Licensee agrees that the following documents form integral parts of this License and their terms and conditions fully cover the use of the Program insofar as provisions of these documents do not conflict with this License:

The said documents (inter alia, any parts thereof) can be unilaterally amended by the Rightholder without any special notice. New versions of the documents shall come into effect upon their publication, unless otherwise stipulated by the new versions.

1.5. This License and all relations associated with the use of the Program shall be subject to the laws of the Russian Federation, and any claims or actions arising out of or in connection with this License or the use of the Program shall be referred to and reviewed by courts at the Rightholder’s location.

1.6. The Rightholder may provide the Licensee with a translation of this License from Russian into other languages. However, in the event of a conflict between the License in Russian and its translation, only the Russian version of the License will be legally binding.

1.7. Terms and Definitions:

1.7.1. Address means an e-mail address in the Licensee's Domain;

1.7.2. Mail System means a system to arrange access to a mailbox and work with e-mail for Addresses in the Licensee's Domain;

1.7.3. Address User means a person who signed up in the Rightholder's services using the Program;

1.7.4. Admin User — hereinafter referred to as the Admin — means a person who connected the Licensee's Domain to the Program;

1.7.5. Address User Account means an account of a person using the Address in the Rightholder's services that stores data (including login and password) to access the Address;

1.7.6. Yandex.Mail means a service of the Rightholder running mail functions, enabling, among other things, the users to send and receive e-mails, store them, keep an address book, etc.;

1.7.7. Licensee's Domain means a domain name registered for or manageable by the Licensee on other grounds.

1.8. By using the Program, the Licensee, the Address User, and the Admin agree to receive promotional messages. The Licensee, the Address User, and the Admin may unsubscribe from promotional messages by using relevant functions of the Program or following instructions specified in a promotional message received.

2. Rights to the Program

2.1. The exclusive right to the Program is vested in the Rightholder.

3. License

3.1. The Rightholder grants, under an ordinary (non-exclusive) license and free of charge, to the Licensee the non-transferable right to use the Program worldwide by applying it as intended within the limits set by this License and the documents specified in cl. 1.4 of this License, by reproducing and distributing it for non-commercial purposes (at no charge).

4. Limitations

4.1. Except when used in the scope and in the ways expressly stipulated by this License or the laws of the Russian Federation, the Licensee may not modify, decompile, disassemble, decrypt and perform any other actions with the object code of the Program meant to obtain information on the implementation of algorithms used in the Program, create derivative works using the Program and otherwise use (allow to use) the Program, without the Rightholder’s written consent.

4.2. The Licensee may not reproduce and distribute the Program for commercial purposes (inter alia, for a fee), inter alia, as part of software product collections, without the Rightholder’s written consent.

4.3. The Licensee may not distribute the Program in any form other than the form received, without the Rightholder’s written consent.

4.4. The Program shall be used (inter alia, be distributed) under the name: Mail for Domain. The Licensee may not change the name of the Program, change and/or delete the copyright notice or other references to the Rightholder.

5. Terms of Use of Certain Functions of the Program

5.1. Some functions of the Program can only be performed with access to the Internet. The Licensee shall independently obtain and pay for such access under terms and as per tariffs of his or her telecom or Internet provider.

5.2. The Program enables the Admin to work with Addresses, free of charge, using functions of Yandex.Mail. All currently available functions of the Program along with any developments thereof and/or newly added functions are subject to these Terms. The program is a full version of Yandex.Mail with its web interface at http://mail.yandex.ru/for/xyz.com (where xyz.com is the address of the User Domain) with all its features, inter alia, each Address will have POP3/IMAP/SMTP available at pop.yandex.ru/imap.yandex.ru/smtp.yandex.ru.

5.2.1. Once signed up, the Address User can use e-mail functions and other services of the Rightholder under terms of use of a respective service and the User Agreement for Services.

5.2.2. Certain Rightholder's services and / or their certain functions may be unavailable to the Address User, for example: signing up in Yandex.Direct (placement of advertising campaigns and advertisements); signing up in Yandex.Market (placement of product offers); signing up in Yandex.Money (setting up an account); registration of the Licensee's Domain in Mail for Domain; uploading photos to Yandex.Fotki; signing up in Moi Krug. Other services and/or their certain functions may be also unavailable to the Address User. The Rightholder may change/extend the list of services and/or certain functions of services unavailable to the Address User at any time, as it thinks fit, without prior notification.

5.3. Using technical features of Yandex.Mail, the Admin creates Accounts for Addresses in Yandex.Mail, manages Address Accounts independently (being limited by technical features of the Program and the requirements set by this License or the documents referred to in cl. 1.4 of this License), inter alia, creates, deletes, and corrects them as it thinks fit.

5.4. The Admin may not use the Program to create the Admin's paid-for services.

5.5. The Admin may not use the Program for mass e-mailing on behalf of the Admin or under its instruction or permission (including e-mails to an indefinite range of addresses, e-mails to addresses chosen automatically, e-mails to an unusually large number of addresses and other cases the Rightholder can deem mass e-mailing at its sole discretion).

5.6. The Admin is solely responsible for making features of the Program accessible to third parties, inter alia, making Address User Accounts in the Licensee's Domain accessible to third parties. The Admin is held liable for any actions of third parties to whom the Admin granted access to the Program under this License. The Admin will be held liable for making such third parties aware of this License and the documents referred to in cl. 1.4 of this License, for all the risks associated with failure to or delay in making such third parties aware of the said documents, and costs of such failure or delay. All actions to use the Program with respect to Addresses in the Licensee's Domain will be deemed to be performed by the Admin. The Admin warrants that its actions meant to make the Program accessible to third parties do not violate the laws, these Terms, and the documents referred to in cl. 1.4 of these Terms, or third-party rights.

5.7. The Admin warrants that it legally owns the Licensee's Domain, trademarks and other design elements usable in accordance with functions of the Program in Yandex.Mail for the Licensee's Domain.

5.8. Except for personalization features provided as a function of the Program and/or Yandex.Mail, the Rightholder independently defines the look and features of Yandex.Mail, including versions intended for the Admin, inter alia, independently decides whether it is possible to place advertisements on Yandex.Mail pages and in what format.

5.9. By using the Program, the Admin authorizes the Rightholder to use the logo, trademark and/or trade name of the Admin and/or the Admin's website for information, advertising and marketing purposes related to the Program and/or Yandex.Mail with no need to secure any additional consent of the Admin and with no remuneration payable to the Admin for such use.

5.10. The Rightholder reserves the right to set any limits and restrictions, including, but not limited to, the below provisions: to limit the number of Licensee's Domains and/or Addresses to be used via the Program and may change them as it thinks fit without prior notice to the Admin.

5.11. The Rightholder may, at any time and at its own discretion, change, reset, block, delete or perform any other actions with any Account at the request of the respective Account Address User without notifying the Licensee and without giving any reason. Using technical tools the Rightholder provided, the Admin may undertake to perform the above actions with Accounts independently, in which case the Rightholder will not perform the above actions with Accounts and will not respond to respective requests of Account Address Users, and the Admin shall provide the Rightholder with valid contact details of the Admin to send such requests.

5.12. Notwithstanding and as an addition to cl. 5.11 of this License, the Rightholder may, at any time and at its discretion, without notifying the Admin and without giving any reason, block or delete any Accounts from the Program, disconnect any Licensee's Domain from the service, or perform any other action, as it thinks fit, with any Account or any Domain of the Licensee in general to meet legislative requirements or respect third-party rights and legitimate interests.

5.13. The Rightholder reserves the right, at own discretion, to limit or completely block Admin access to the Program (or to certain functions of the Program, if technically feasible), if these Terms are violated more than a few times, or to take other measures against the Admin to meet legislative requirements or respect third-party rights and legitimate interests, inter alia, to disconnect any Licensee's Domain from the Program and prohibit such Admin to connect any other domains to the Program.

6. Amendments to this License

6.1. This License can be unilaterally amended by the Rightholder. User notices of amendments made in this License are posted at: https://yandex.kz/legal/domain_software_agreement. The said amendments to the terms and conditions of the License shall come into effect once published, unless otherwise specified in the relevant publication.
