Terms of Use for the Yandex Disk Service

1. General Provisions

1.1. This document (hereinafter referred to as the "Terms") establishes the terms of use for the Yandex Disk service (Disk) and constitutes an integral part of the General Terms of Use for Yandex 360 Services, posted at: https://yandex.kz/legal/360_termsofuse (hereinafter referred to as the "General Terms").

By starting to use the Yandex Disk service/its individual functions, the User/Corporate Client shall be deemed to have accepted these Terms and the General Terms in full, without any reservations and exceptions.

The current version of the Terms is always available on the Internet page at: https://yandex.kz/legal/disk_termsofuse/.

In case of disagreement by the User/Corporate Client with any of the provisions of the specified documents, the User shall not be entitled to use the Yandex 360 services.

1.2. The unified rules and principles for the use of Yandex 360 services, provisions on intellectual property, personal data processing, and liability shall be governed by the General Terms, taking into account the specifics contained in these Terms.

2. Features of the Use of the Yandex Disk Service

2.1. Yandex provides the User/Corporate Client with the opportunity to use the Disk to place files (hereinafter referred to as "files" or "data") on the disk space of Yandex servers, to store files in the specified space, to synchronize files with devices, to view files, modify them, delete them, control access to them by third parties, as well as in other ways that do not contradict the provisions of these Terms and the documents to which they refer.

2.2. The Disk offers the User functionality that allows creating and editing notes, including forming lists and adding images, as well as storing notes on the disk space of Yandex servers and synchronizing them with the User's devices. These functions operate in a limited functionality mode. Yandex reserves the right to make any changes to the structure and algorithms of the functions, suspend their operation, change or terminate their performance without prior notice to the User.

2.3. The use of the Disk is carried out using a Yandex ID account. The User's/Corporate Client's employee's login (account name), as well as data from the fields "First Name", "Last Name", "Gender", and "Name at Yandex" specified during the registration (use) of such login, along with the image from their profile page (avatar) and e-mail address, may be displayed and made available to third parties, inter alia, in the Disk event log when the User/Corporate Client's employee grants or receives shared access rights to data, when leaving comments on a page with data for which shared access rights have been granted, as well as when sending invitations and accepting invitations from third parties.

2.4. The Disk includes functionality for Users that allows compiling automatic selections of photos uploaded by the User and stored in the User's disk space via the mobile application (hereinafter referred to as "Albums"). Albums are formed automatically by processing photos with a special algorithm that does not imply access to or viewing of photos by third parties. The User may be provided with the ability to create a short video from photographs stored in the User's disk space and musical fragments provided by Yandex (hereinafter referred to as "Memories") using the Yandex Disk mobile application (https://yandex.kz/legal/disk_mobile_agreement).

2.5. The Disk may provide the User with functionality that allows creating scanned copies of images obtained from the User's device camera using the Yandex Disk mobile application (https://yandex.kz/legal/disk_mobile_agreement/) and/or the Yandex Mail mobile application (https://yandex.kz/legal/mail_mobile_agreement/), and saving them on such device and/or on the User's disk space (hereinafter referred to as the "Scanner"). The Scanner is provided using the Yandex Smart Camera function on the terms specified in the License Agreement for the use of the Yandex program for Mobile Devices (https://yandex.kz/legal/search_mobile_agreement/). The User shall be solely responsible for ensuring that the content of scanned copies of images obtained using the Scanner function complies with the requirements of applicable laws, including liability to third parties.

2.6. The User may have access to document editing functionality provided by the R7 Office service (https://r7-office.ru/, JSC "R7", OGRN 1025202837615) under the terms posted at: https://r7-office.ru/license-agreement/. Yandex is not responsible for the operation of the R7 Office service, does not guarantee the correctness of its operation, and is not liable for damages caused by the unavailability or inability to use the R7 Office service. In case of malfunctions or any issues or claims, the User may contact JSC "R7" at the addresses specified on the Internet page: https://r7-office.ru/.

2.7. The User may have access to file processing functionality provided by the Wfolio service (https://wfolio.ru, LLC "Perspektiva", OGRN 1147847022564) under the terms of the user agreement (https://wfolio.ru/terms). Yandex is not responsible for the operation of the Wfolio service, does not guarantee the correctness of its operation, and is not liable for damages caused by the unavailability or inability to use the Wfolio service. In case of malfunctions or any issues or claims, the User may contact LLC "Perspektiva" at the addresses specified on the Internet page: https://wfolio.ru.

2.8. The User may save Memories to their device or provide access to other Users. In this case, the User shall be solely responsible for ensuring that the content of the Memories complies with the requirements of applicable laws, including liability to third parties. Yandex grants the User a non-exclusive right to use the provided musical fragments as part of the Memories in any manner not prohibited by law for non-commercial purposes. The right to use musical fragments as part of the Memories is granted free of charge. The User can hide the Memories functionality using the features available in the Yandex Disk mobile application.

2.9. The User independently determines how to use the Disk and bears responsibility for such use. The User is responsible for the compliance of the content of any file placed by the User with the requirements of applicable laws, including liability to third parties in cases where the placement of a file by the User infringes the rights and legitimate interests of third parties.

2.10. Yandex technical support staff may have access to file attributes (name, type, size, etc.) stored by the User on the disk space of Yandex servers for the purposes of processing user requests and providing technical support; however, Yandex technical support staff shall not have access to the content of files unless public access to the file has been granted.

2.11. When using the Disk, the User shall refrain from placing such data and performing such actions, the placement and performance of which are prohibited by the User Agreement for Yandex Services and the General Terms. The use of the Disk and/or individual functions of the Disk for unscrupulous purposes, and the performance of actions aimed at or entailing the violation of the rights and legitimate interests of third parties, is prohibited.

2.12. Yandex reserves the right to block access to files placed by the User, or to delete such files, and to transfer to a third party data about the User obtained in connection with the provision of the Disk in the following cases:

2.12.1. if a regulatory act imposes an obligation on Yandex to take such actions;

2.12.2. if Yandex receives from a third party a complaint, claim, inquiry, demand, or any other notice stating that the placement of a file has infringed a third party's rights or violated applicable laws;

2.12.3. if the placement of a file poses a threat to the normal operation of the Disk;

2.12.4. if Yandex receives a judicial act or an act issued by a law enforcement body imposing an obligation on Yandex to take such actions.

2.13. Yandex reserves the right to delete files placed by the User if a File continuously remains in the Disk "Trash" section for 30 (thirty) calendar days. A Corporate Client may be provided with the ability to restore deleted files of employees via the "Organization Trash" storage, subject to the limits and restrictions existing in such storage.

2.14. Yandex reserves the right to restrict the User's access to the Disk (block it), as well as to delete any or all files and data stored on the User's disk space, in the following cases:

2.14.1. if the User exceeds the restrictions and/or limits set for the corresponding type of use, as well as if the User changes the file type in order to circumvent the rules or limits provided for in the Disk (hereinafter together – "exceed the limits"). Yandex reserves the right to notify the User about exceeding the limits, as well as about the upcoming blocking and deletion of files. In case of failure to take necessary measures, including adjustment of limits, Yandex is entitled to block the User after 44 days from the start date of exceeding the limits, and after 90 days from the date of blocking, permanently delete the User's files and data from the disk space.

2.14.2. if the User fails to take any action to use the features of the Disk for two consecutive years. Yandex reserves the right to notify the User about the upcoming blocking and deletion of files. If no response is received from the User and/or the User fails to take action in the Disk, Yandex is entitled to block the User after seven (7) days from the date of notice, and after ninety (90) days from the date of blocking, permanently delete the User's files and data from the disk space.

2.15. The total volume of incoming data/files uploaded by the User to the Disk during every 30 days, starting from the moment of the first upload of files/data to the Disk (hereinafter referred to as the "Upload Period"), regardless of the upload source (direct upload, mail attachments, mobile application, etc.), cannot exceed the volume available to the User in the Disk during the current Upload Period. The file/data, the uploading of which will exceed the specified limit, will not be uploaded to the storage during the current Upload Period. The available volume for uploading data/files to the Disk is communicated to users by publishing the relevant information in the Help sections.

2.16. The Disk provides the User with the ability to distribute data by granting shared access to a file (providing access to a file to several specific Users of the Disk) or by granting public access to a file (providing access to a file to any users of the Internet who know the file's address as a link). When using the Disk's data distribution capabilities, the User must act in good faith and refrain from abusing these functions. In particular, the User undertakes to refrain from organizing mass file-sharing using the Disk's functions. Yandex reserves the right to apply rules, limits, and restrictions aimed at preventing, restricting, and terminating mass file-sharing.
